Meeting Information

Council meetings for the new City Council are held at the CPN Community Center (7404 Yorkshire Drive), when available, and the HOA #1 Clubhouse, 7233 Tenby Way, across from Buffalo Ridge Elementary School.

Council meetings begin at 7 p.m., with time allowed at the beginning of each meeting for public input. A study session is held before each council meeting beginning at 6 p.m. While public input is not permitted at the study session, meetings are open to the public.

Council Meeting: Aug. 10, 2010

Study Session

  • City Council Training – Code of Conduct and Code of Ethics - City Attorney Linda Michow explained the City’s policies on this topic and emphasized that personal rights are often sacrificed due to the (public trust) responsibilities that come with being an elected official. Also explained was the statutory limit for accepting gifts of $50 per year, proper meeting conduct, confidentiality, and mandatory standards of ethical standards and consequences. The City Council operates on a non-partisan basis.

  • Board of Adjustment – Sam Bishop, Planning Director, provided a brief training on the roles and purpose of the Zoning Board of Adjustment (BOA),  reviewing the types of variances, criteria for granting variances, staff’s authority, the variance process, and the role of the BOA.

  • Committees of Council – Interim City Manager Gary Suiter reviewed a proposed resolution that reorganizes the Council’s citizen advisory committees. This is a continuation of a discussion from a recent Council Retreat, at which Council decided to revamp their committee structure and clarify their roles. Council agreed in concept to the proposed changes. This item will be brought to Council for formal action at their next meeting.

  • Municipal codification – Deputy City Clerk, Carl Kollmar updated the Council on the results of a preliminary bid process for municipal codification. This will put all of the City’s laws and ordinances in an easy to use format, while providing convenient on-line access to the codes for the public.

Regular City Council Session

Citizens’ Comments
Terry Wiebold, Castle Pines Connection thanked the City for their participation with the newspaper and requested that the City post a link to the CP Connection on the City’s website. The paper’s deadline has been changed to 15th of the month.

Sally Norris stated a concern about the City’s “checks and balances” and Council representation on City Boards. She volunteered her services to serve on these Boards.

Resa Labossiere appeared on behalf of the citizen’s initiative committee opposing continuation of the URA. She pointed out an error in information on the City’s website, and urged Council to take action on the petition.

Dwight Zemp asked 3 questions:

  1. Please explain the additional $10,000 monthly expense from CH2M HILL
  2. What is the additional $25,000 billed in June for “catch up”?
  3. It is possible to switch to a Modified Accrual Basis of accounting for the larger expenses?

Council Business

  • Ordinance 10-03 – Extending and Amending the Temporary Moratorium on Medical Marijuana Centers, etc. This ordinance extends the current moratorium on medical marijuana dispensaries to July 1, 2011, and includes the specific uses identified in House Bill 1284, including cultivation centers, and infused products manufacturing facilities.  The ordinance may also expire upon the effective date of the rules adopted by the Department of Revenue. This ordinance was approved on second reading by the City Council on a 5-0 vote.

  • Ordinance 10-04 – Adopting Licensing Regulations for Sexually–Oriented Businesses (SOBs). This ordinance proposes to regulate the licensing and business operations of SOBs in Castle Pines North. This is proposed as an Emergency Ordinance in order to have an effective date prior to the expiration of the existing moratorium. The operating hours are being limited from 10:00 a.m. – 10:00 p.m. The ordinance also includes other operational parameters, such as a presence of a registered manager on the premises at all times. The Council deferred action on this ordinance to a future meeting, when a super-majority (6 Council members) will be present.

  • Ordinance 10-05 – Amending Certain Provisions of the Zoning Ordinance Relating to the Regulation of Sexually Oriented Businesses. This emergency ordinance addresses the zoning and placement of sexually–oriented businesses (SOBs) in the City. It allows SOBs in the Business Zoning District, with a spacing requirement of 350 feet between such businesses and other protected uses such as churches, schools, daycare centers, etc. Several members of the public commented on the proposed ordinance and discussion ensued. The Council deferred action on this ordinance to a future meeting, when a super-majority will be present.

  • Resolution 10-61 – Expressing Gratitude and Support for the Work of CP Green – As a part of the reorganization of the Council Committees, this citizens committee is being “spun off” to operate independently. Council thanked the committee for their work and approved this Resolution on a vote of 5-0.

  • Resolution 10-63 – Appointing New Members and Alternate Members to the Board of Adjustment on an Interim Basis – Council approved this Resolution on a vote of 5-0 and asked staff to advertise for community members to sit on this Board.

  • Resolution 10-64 – Approving an Intergovernmental Agreement (IGA) between the Douglas County Clerk and Recorder and the City of Castle Pines North regarding the Conduct of a Coordinated Election – Council approved this IGA on a vote of 5-0.

  • Discussion – Initiative Petition Status Update/Proposed Ballot Questions – Council was updated on the status of the citizen’s initiative petition on the URA. The signatures have been verified by the City Clerk and City Council directed staff to draft the appropriate ballot language for action at their next regular meeting.

  • Resolution 10-65 – Opposing Proposition 101 and Amendments 60 and 61 – Council approved this resolution concerning 3 stateside ballot initiatives that will be on the November ballot on a vote of 5-0 .

  • Resolution 10-66 – Approving a Professional Services Agreement with Clifton Gunderson LLP for Provision of Consulting Services to the City of Castle Pines North. This agreement is for studying various scenarios of potential cost savings resulting from the integration of the City and CPN Metro District. The Mayor requested that staff combine meetings between the two entities for efficiency. Council asked that they be involved with developing the assumptions.

City Manager’s Report

Interim City Manager, Gary Suiter, provided an update on a request for proposals for public relations and communications services. Proposals are due August 20.  He also discussed department reports, budget, and calendar items.

City Council Reports

Council Members gave updates and reports from their respective sub-committees and Ward meetings. Street repairs are being completed and the City is making every attempt to replace worn out concrete within our financial limits.

Executive Session

Executive Session pursuant to:

a)  C.R.S. Section 24-6-402(4)(e) for the purpose of determining positions relative to matters that may be subject to negotiations, developing strategy for negotiations, and/or instructing negotiators and pursuant to C.R.S. Section 24-6-402(4)(b) for legal advice in regard to integration and/or dissolution of the Castle Pines North Metro District, and

b)  Executive Session pursuant to C.R.S. Section 24-6-402(4)(e) for the purpose of determining positions relative to matters that may be subject to negotiations, developing strategy for negotiations, and/or instructing negotiators and pursuant to C.R.S. Section 24-6-402(4)(b) for legal advice in regard to Urban Renewal Authority legal filings.

No decisions were made following the executive session.
